华东政法大学法律史研究中心是成立于2004年的高水平研究机构。中心以华东政法大学国家级重点学科法律史学科为依托,整合各方科研力量设立而成。中心现有学科成员29人,其中博士生导师6名,教授10名,副教授(副研究员)9名,讲师(助理研究员)10名。本中心为全国外国法制史研究会会长及秘书处所在地、中国儒学与法律文化研究会会长及秘书处所在地、上海法学会外国法与比较法研究会会长及秘书处所在地。
本中心由于明教授担任主任。科研实力雄厚,成果丰硕。已出版个人专著、主编、参编著(译)作百余部,其成员亦在《中国社会科学》《法学研究》《历史研究》《中国法学》《中外法学》等权威期刊上发表论文近三十余篇,中文核心期刊上发表论文数百篇,并主持国家社科基金重大项目和其他国家级、省部级项目多项。本中心现有《出土文献与法律史研究》(CSSCI收录集刊)《外国法制史研究》《法律史研究》等多种学术刊物。
本中心的研究领域包括中国法律史、外国法律史和比较法律史。在中国法律史领域,中心具有一支人员搭配齐整、研究脉络贯通古今、同时又极具鲜明学术特色的研究团队,在全国范围内极具影响。团队不仅在隋唐、明清、近代法律史领域积淀深厚,近年来尤其在与出土文献相关的先秦秦汉法律史等领域形成了鲜明特色,其影响力已跨越法律史领域,延伸至简牍学与历史学界。团队以国家社科基金重大项目为依托,尝试全面梳理甲骨、金文、简牍中的丰富法律史料,从而为探索中华法制文明的起源动力提供坚实可靠的资料支撑,推出了《甲骨、金文、简牍法制史料提要》《中华法制探源考证》(13卷本即出)等为代表的一系列优秀成果。
外国法律史和比较法律史领域的研究实力在全国居于领先地位,已形成了鲜明的研究特色与丰硕的研究成果。我们不仅对罗马法、大陆法系、英美法系等西方法律文明有着精深的研究,对非洲法、东亚法、印度法等法律文化圈也有着系统性的探索,通过对世界各主要法律体系的历史源流、制度变迁与思想演进的深入剖析,致力于揭示法律文明发展的多元路径与内在规律,为理解当代全球法律格局提供了深厚的历史镜鉴。近年来中心陆续出版了“法律文明史”系列丛书、“区域国别法律发达史”系列丛书、《“一带一路”沿线国家立法文本选译汇编》等重量级学术著作。强化“区域国别法”的特色方向,聚焦于“一带一路”沿线国家、主要经贸伙伴及关键区域的法制史与当代法律实践研究。
本中心是国内最早设立硕士点(1981年)及较早设立博士点(2001年)的学术机构。近年来本中心已成功举办多届全国外国法制史研究会年会、中国儒学与法律文化研究会年会、出土文献与法律史研究等全国性学术会议。定期举行各种学术交流活动,并将在已有的科研成果基础上再推出一批新的学术成果,继续大力推动法律史学的学术研究和交流,整合、凝聚上海乃至全国从事外国法与比较法研究的力量,提升法律史学研究的水平,为建设社会主义法治国家服务。
Introduction to the Research Center for Legal History, East China University of Political Science and Law
The Research Center for Legal History at East China University of Political Science and Law (ECUPL) is a leading research institute established in 2004. Building on ECUPL’s nationally designated key discipline in legal history, the Center brings together research resources from multiple sectors. It currently has 29 faculty members, including 6 doctoral supervisors, 10 professors, 9 associate professors (or associate researchers), and 10 lecturers (or assistant researchers).The Center serves as the headquarters and secretariat for the National Institute for Foreign Legal History, the Society for Confucianism and Legal Culture of China, and the Society for Foreign Law and Comparative Law Studies of the Shanghai Law Society.
The Center is currently directed by Professor YU Ming. It boasts strong research capacity and outstanding achievements. Members of the Center have published over a hundred monographs, edited or co-edited volumes, and translations. They have also contributed nearly thirty papers to top-tier academic journals such as Social Sciences in China, Chinese Journal of Law,Historical Research,China Legal Science, and Peking University Law Journal, along with hundreds of papers in core Chinese journals. The Center has undertaken multiple major projects funded by the National Social Science Foundation of China, as well as other national and provincial-level research projects.The Center currently hosts several academic publications, including Studies on Excavated Documents and Legal History (CSSCI-indexed series), Studies on the Legal History of Foreign Countries, and Studies in Legal History.
The Center’s research covers both Chinese Legal History, Foreign Legal History and Comparative Legal History. In the field of Chinese legal history, the Center has formed a highly coordinated and distinct research team whose work spans from ancient to modern times, and it enjoys broad national influence. Not only has the team made significant contributions to the study of Sui–Tang, Ming–Qing, and modern legal history, but in recent years it has also developed a distinctive focus on the legal history of the Pre-Qin, Qin, and Han periods—particularly research based on excavated legal documents. Its influence now extends beyond the discipline of legal history into bamboo-slip studies and historical philology.Supported by major projects from the National Social Science Foundation, the team systematically collates rich legal-historical materials from oracle bones, bronze inscriptions, and bamboo and wooden slips, thereby providing a solid empirical foundation for exploring the origins and dynamics of Chinese legal civilization. Representative achievements include An Annotated Catalogue of Legal Materials in Oracle Bones, Bronze Inscriptions, and Bamboo Slips and the forthcoming thirteen-volume series Critical Studies on the Origins of Chinese Legal Civilization.
The Center’s research in Foreign Legal History and Comparative Legal History ranks among the best nationwide, characterized by distinctive focus and substantial achievements. It has conducted in-depth studies on Roman Law, the Civil Law System, and the Common Law System, while also engaging in systematic explorations of African Law, East Asian Law, and Indian Law.By analyzing the historical origins, institutional transformations, and intellectual evolution of major legal traditions worldwide, the Center seeks to reveal the pluralistic pathways and internal logic of legal civilization, providing deep historical insight for understanding the contemporary global legal order.In recent years, the Center has successively published several major academic works, including the “History of Legal Civilization” series, the “History of Legal Development in Regions and Countries” series, and A Collection of Selected translation of Legislative Texts of Belt and Road Countries. Strengthening its distinctive orientation in “Regional and Country Law Studies”, the Center focuses on the legal history and contemporary legal practices of countries along the Belt and Road, as well as key trading partners and strategic regions.
The Center is one of China’s earliest institutions to offer a Master’s program in Legal History (since 1981) and among the earlier ones to offer a Doctoral program (since 2001). In recent years, it has successfully hosted multiple annual conferences of the National Institute for Foreign Legal History, the Society for Confucianism and Legal Culture of China, and national symposia on Excavated Documents and Legal History.The Center regularly organizes various academic exchange activities and, building upon its existing achievements, continues to produce new scholarly contributions. It remains committed to advancing the study and dialogue of legal history, consolidating research forces in Shanghai and across China in the fields of foreign law and comparative law, and contributing to the development of legal-historical scholarship and the construction of a socialist rule-of-law state.
